This gets us into the whole fetus rights debate. When does life begin crap.
Although I am pro choice, I do feel that with all the knowledge we have, that if a woman drinks heavily throughout the pregnancy, and the baby is still born, she should be charged. This is not something that she could possibly plead ignorant.
But I would fear for women whose baby is still born thru no fault of her own. It would come down to her word against others. My X was recently pregnant after she remarried. Her baby was still born, and I know that she nor her new husband did anything wrong. But what if someone accused her of drinking.

Its either a child or a unviable tissue mass - it can not be both. Just my opinion and the opinion of any child who has had its arms ripped off during the "procedure"..

Sounds to me like it would be a civil matter, if anything. If the child (or his or her legal guardian) chose to sue the birth mother for negligence. But it would be awfully hard to prove the level and frequency of the birth mother's intoxication and that it was the direct contributing factor to the child's resulting condition, without a reasonable doubt.

there's no way she could be ignorant about not drinking because throughout pregnancy the doctor tells you NOT to consume alcohol... once the brain and organs and body is developed, IMO it is the same as giving a baby 151 in a bottle. so to answer this question, YES i do thnk they should lock her ass up and throw away the key. or burn her ass on a stake. with 151.
