The ex and I filed a joint return last year. More money for the two of us. This would be the first year we didn't file a joint return. The state of OR is giving kicker returns. Ours was used to pay court fines he had without my knowledge.
I followed the instructions on the letter and called to process getting my half of the return. I was told that since I didn't contribute any income that I wasn't eligible for my portion of the return. My name is on the return, how is this ok?

Ummmm I'm not sure they can since it was Joint. Who did you speak with?

The short time I was on the phone with her I could tell she was one of these women with penis envy though. Her whole demenor changed when she found out I had been a stay at home mom. I hate it when women think they are superior just because they have a career. I have just as much education as this woman, if not more, and she couldn't handle what I do in a single day. I finally got her to give me the fax # for the attrition dept so I can appeal and try to get my portion of the return though she didn't give it up easy.

Good for you. Pursue it to the highest lvl. That is bs and definitely find some other person to talk to that doesn't make an assinie assumption.

LOL, I did find out through someone else in the deptartment that I can file a joint return again this year. We were still legally married for the first half of the year. Without that I wouldn't get a return, and he wouldn't get back much on his own. This way I can more back for the kids. What really ticks me about the whole situation is that they are the one's suffering while everyone holding the cards seems to think I am a money grubbing bitch. He tried to destroy me financially. I just need a break to get us caught up. I can do without, and will continue to do so, but they deserve better than this.

Good for you!! You are right. No sense in letting the little ones suffer, esp when you can fight for it.

A friend of mine's husband owed back child support and they took their entire joint return and gave it to hsi exw for child support. she fought it and got back her portion of the return, but it did take Month and months (8 or so if I remmeber).

I faxed everything off on Friday. We'll see how long it takes to get this straightened out.

I have heard of this happening many times or vice versa. They will also sometimes take your money if you owe people that your accounts goto collections, but that is rare. I cringe when I think about that one.
