I'm not even fully sure what this means. Basically he's ignored the separation agreement. As a result, he doesn't only owe me money (for his half of the cost of refinancing the house to get his name off of the mortgage), he never registered the car that I signed over to him in his name in his new state, resulting in backtaxes due in both of our names, and preventing me from registering my own car. I've informed my lawyer and was told this is what she is going to do since he won't respond to phone calls or emails.
To throw another wrench into the works, I've heard through the grapevine that he is moving/has moved to a different state, so I don't even know if the address on the divorce paperwork is still valid. I've asked my lawyer to contact his parents.
I feel stupid, but can anyone explain what his being served means? I really hope not to have to go back to court. I want to just put everything behind me and move on, but I also want to be able to register my own damn car!
Thank God I never had children with this man. I can't even begin to imagine what a deadbeat he would be, which is a very sad thought indeed.

I don't know what the official term, "being served" means, but when my lawyer took some legal action, ie. filing some papers at the courthouse for whatever, the ex got notified of the paperwork. I think that means being served. Your ex will be notified that legal action is being taken because he hasn't done what he should have done.
He is a PIA. I had a similiar situation with one of the cars in my divorce. I went into the DMV website under the registration of the car I had signed over. There was a check box that said "I have sold this vehicle", so I checked it and hit "Submit" Lo and Behold, the car doesn't show up on my record anymore. Maybe your state has a similiar option.

Thank God I never had children with this man. I can't even begin to imagine what a deadbeat he would be, which is a very sad thought indeed. That is a sad realization. I don't know about the US, but here in Canada, you can do actual time in jail in a cell for being in contempt of court....not that it would *encourage* him to pay you what he owes for the house to be in a cell. Hopefully, he finds out about the motion and actually starts to do some of the things he was supposed to look after. It's tiresome I know. Hugs.

Well if he's going to be a child, he can at least ask his new "mommy" to write a damn check for him. And, NO, I'm not picking up my toys and going home... but, no worries, moving forward at a rapid rate (despite minor freakouts along the way ).

Well if he's going to be a child, he can at least ask his new "mommy" to write a damn check for him. Hahahaha... I just heard from my lawyer's office. He called after being informed he would be taken to court and forced to pay all legal fees in addition to what he owes if he didn't pay up immediately. I guess his "new mommy" won't write the damn check afterall because he said that his PARENTS would write me a check and send it to me this week.

P.S. Write on a sheet of Paper that says you have not owned his car since * when'ever Date* Have it Noterized Take it to the place where you get your Car put in your name And give it to them may or may not work

Thanks, Freck, but I went to town hall months ago (the day I tried to register my car) with the divorce decree and separation agreement, in which everything regarding my signing the car over to him is noted. It didn't matter -- the issue was the back taxes, and they don't accept divorce decrees as proof that I'm not responsible for payment. Supposedly he (or his parents ) paid the back taxes, and he is waiting for a receipt from the town which he will forward to my attorney's office.
